Welcome to the ELSEWHERE Presets online store. This website and all digital products sold through it are operated by ELSEWHERE Presets.

By purchasing or downloading any digital products from our site, you agree to the following Terms & Conditions.

1. Digital Product License

All digital products sold on this site, including Lightroom presets, editing tools, templates, and digital resources, are licensed, not sold.

You are granted a non-exclusive, non-transferable, single-user license to use these products for personal or commercial creative projects, including client work.

You may not:

Resell, redistribute, or repackage the digital files in any form
Claim our products as your own
Share, gift, or transfer the files to others
Install or distribute the files to multiple users within a team, studio, or organisation

Each purchase grants one license for one user.

If presets are required for use across multiple users within a studio or organisation, each user must purchase their own license.

2. Refund Policy

Due to the digital nature of our products, all sales are final.

Once a product has been purchased and delivered, we are unable to offer refunds, exchanges, or cancellations.

Please review all product descriptions carefully before purchasing. If you have any questions, contact us before completing your order.

If you experience any issues accessing or installing your files, please contact our support team and we will be happy to assist.

3. Delivery

Upon successful payment, your digital files will be delivered instantly via email and/or download link.

If you do not receive your files within a reasonable timeframe, please check your spam or junk folder.

If you are still unable to access your files, please contact our support team.

4. Usage Rights

Your license allows usage across unlimited personal and client photography projects.

However, you may not use our products to create competing products or services, including but not limited to:

Preset packs
Editing tools
Design templates
Photography resources
Educational materials or training products

You may not distribute, sell, or include our products within any course, bundle, membership, template library, or digital resource without explicit written permission from ELSEWHERE Presets.

We reserve the right to revoke access and pursue legal action if we detect license abuse or unauthorized distribution.

5. Intellectual Property

All content and digital products on this site are the intellectual property of ELSEWHERE Presets.

These assets are protected by copyright and intellectual property law.

Unauthorized reproduction, redistribution, resale, or public sharing of our products is strictly prohibited.

Purchase of our products does not grant permission to use the “ELSEWHERE” name, branding, or trademarks in your own product titles, marketing materials, or preset offerings.

6. Reverse Engineering & Extraction

You may not reverse engineer, deconstruct, extract settings from, or otherwise analyze these presets for the purpose of replicating their structure, formula, or aesthetic for use in competing preset packs or digital products.

The presets may not be used as a base or starting point for creating derivative preset packs intended for resale or distribution.

7. Unauthorized Distribution

Uploading, distributing, or sharing these presets on file sharing platforms, preset libraries, piracy websites, torrent platforms, forums, or messaging groups is strictly prohibited.

This includes both free and paid distribution.

If we discover unauthorized distribution of our products, we reserve the right to pursue legal action, DMCA takedowns, and license enforcement measures.

8. License Monitoring & Enforcement

ELSEWHERE Presets reserves the right to monitor the internet for unauthorized distribution or resale of its products.

Where necessary, we may issue copyright enforcement notices, DMCA takedowns, or other legal remedies to protect our intellectual property.

Accounts found to be abusing or violating licensing terms may have their licenses revoked without refund.

9. Limitation of Liability

ELSEWHERE Presets shall not be liable for any damages, data loss, or issues resulting from the use or misuse of our products.

Results may vary depending on camera model, lighting conditions, software versions, exposure settings, and individual editing workflows.

10. Governing Law & Jurisdiction

These Terms & Conditions, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales.

You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms & Conditions.
